Who pays for the damage when a tree falls on your car?

CHARLOTTE, N.C. — Tiffany Akomani and her husband were driving on West Boulevard in Charlotte when a tree fell on their car and shattered the back window.

She’s thankful no one was injured and that her children weren’t riding in the car at the time.

“Honestly, I didn’t know what it was. I thought it was a gunshot,” she told Action 9′s Jason Stoogenke.

“All I can think of is, if it was two seconds sooner, it could have hit the front and, God forbid, me and my husband might not even be here right now,” she said.

Akomani told Stoogenke that she ended up having to use her own insurance to pay for the damage, however.

A Gaston County driver also told Stoogenke she was on Highway 274 when a tree fell and damaged her vehicle. She said her insurance had to cover the damage as well.

Stoogenke investigated why the women had to use their own insurance to cover the damage. He discovered that property owners must maintain trees that on their land and if they know or suspect that a tree may fall, they are required to do something about it. Otherwise, they’re not responsible if someone gets hurt or if something, such as a car, gets damaged. The victim has to foot the bill.
