Driver who ran from scene of fatal crash facing DWI, murder charges, CMPD says

CHARLOTTE, N.C. — A man was facing several charges after police said he ran from the scene of a deadly hit-and-run crash Sunday morning in west Charlotte.

James Winston, 22, was initially charged with DWI when he was taken to a local hospital to be treated for injuries from the crash.

On Wednesday, he was released from the hospital charged with second-degree murder, felony death by motor vehicle, felony hit-and-run, possession of a stolen motor vehicle, reckless driving, driving while license revoked, possession of marijuana and having an open container (liquor).

The crash happened around 3:30 a.m. on Wilkinson Boulevard, between Old Steele Creek Road and Ashley Road.

Two cars were involved in the collision -- an Acura ILX driven by Winston, and a Toyota Camry driven by Nigel Brown.

According to investigators, the Acura was speeding east on Wilkinson Boulevard when it struck the Toyota, which had been turning left onto Donald Ross Road. Brown, 21, was pronounced dead at the scene.

Winston ran away from the crashed Acura, but his passenger, Tyrek Boyd, stayed in the car, police said. He was taken to the hospital but will be OK.

Winston later showed up at the hospital to be treated for his injuries and was charged with DWI.

Police said the Acura Winston was driving had been stolen in Charlotte on Feb. 4. Detectives also said Winston was driving while impaired, his license was revoked and he had an open container of liquor in the vehicle. Excessive speed, recklessness and alcohol are contributing factors in the crash for Winston, CMPD said.

Winston’s passenger, Boyd, was charged with possession of alcohol by a person under 21.

Inbound Wilkinson was shutdown between Old Steele Creek Road and Ashley Road for hours while police investigated the scene.
