CHARLOTTE — Mecklenburg County Sheriff Garry McFadden tells Channel 9 19 detainers have been issued since House Bill 10 went into effect at the beginning of the month. He says ICE hasn’t picked up any of the suspects.
Channel 9 reviewed court documents of all 19 suspects. Of the 19, five have been released from the Mecklenburg County Jail after their detainer holds expired.
Records show an ICE detainer was issued for suspected Honduras citizen Allan Jose Rivera Osorio. The 37-year-old was arrested in Mecklenburg County last week after police say he ran away from them during a traffic stop. He was previously arrested after his wife says he hit her.
ICE also got a detainer for 34-year-old Saul Rodriguez-Hernandez who was arrested after police say he punched his girlfriend in the mouth.

Records show this week they were both able to leave the Mecklenburg County Jail. They’re two of 19 people in Mecklenburg County who have had a detainer on them since House Bill 10 went into effect at the beginning of this month. But so far, Mecklenburg County Sheriff Garry McFadden says ICE hasn’t taken action.
“Nobody’s been removed by ICE,” McFadden said.
House Bill 10 requires sheriffs to hold suspects with a detainer from ICE for up to 48 hours before they can be released. That’s even if they can pay their bail.
Charges for the five people who have been released after having a detainer include DWI, domestic violence, and assault.
ICE tells Channel 9 they are researching the situation but says there are different standards for when they will pick suspects up.
McFadden says it costs $181 a day to hold someone. That extra $362 dollars isn’t covered by the state. He says that will add up.
“That is solely on the residents of Mecklenburg County,” he said.
Charges for the remaining 14 people with detainers range from assault with a deadly weapon to indecent liberties.
