KING MOUNTAIN — The case of a Kings Mountain man accused in a shooting that killed one man and left another with serious injuries will go before a grand jury Monday.

James Ussery is accused of shooting two men Wednesday night, Kings Mountain police said.

Ussery's family told Eyewitness News that he shot at the men because they were trying to get inside his home.

One of the victims, Sherman Addison, said he was not trying to force his way into the home. He said that he and his uncle, Sedrick Hartgrove, were invited there.

"I was just screaming, 'Uncle, uncle it's going to be all right,'" Addison said.

Police found both men with gunshot wounds on the ground, waiting for help on the 700 block of West Gold Street.

Addison woke up in the hospital to learn that Hartgrove was dead.

"My uncle was a good man. My uncle didn't deserve to die the way he died," Addison said.

Witnesses told Kings Mountain police that Hartgrove and Addison were trying to get into Ussery's home, causing an argument and shoving match that ended when Ussery opened fire.

Hartgrove's girlfriend, Farren Mercer, said she was at the scene.

"It was awful," Mercer said.

She and Addison said that they were invited to Ussery's home for a cookout. She said they were trying to leave when Ussery started shooting.

"What I saw was not self-defense when someone is trying to run and you shoot him," Mercer added.

Addison pointed to where he says a bullet pierced his back and went through his neck. He is grateful he survived, but heartbroken like the rest of his family by Hartgrove's death.

"Sedrick was a kind person. He would give you the shirt off his back," said his brother, Chris Williams.

As the family prepares to lay the father of two to rest, they are also committed to seeking justice and sharing their side of the story.
