CHARLOTTE — A 49-year-old man was arrested in California and charged with a sexual assault cold case in 1998 that happened in Charlotte.
On October 16, 1998, the victim, who was 48 years old at the time, told police that someone she didn’t know pushed her to the ground and attempted to sexually assault her.
The victim was treated at a nearby hospital and a sexual assault kit was completed.
In 2004, there was a DNA profile obtained from the original evidence collected in 1998.

In 2020, detectives with the Charlotte-Mecklenburg Police Department’s Cold Case Unit were alerted about a DNA match after the suspect, David Earl Allen, was arrested in Michigan for an unrelated crime.
The DNA profile was a match with Allen and warrants were issued for his arrest.
In August of 2021, Allen was arrested in Sacramento, California, with CMPD’s assistance.
Allen was extradited to Mecklenburg County and charged with first-degree kidnapping, and second-degree attempted rape.
The investigation is ongoing.
